End User License Agreement

Please read this agreement carefully before using RidePack.

Important By downloading, installing, or using RidePack, you agree to be bound by the terms of this End User License Agreement. If you do not agree, do not install or use the App.

1. Acknowledgment

This End User License Agreement ("Agreement") is between you ("User") and Matthew Azevedo, the individual developer of RidePack ("Developer") — not with Apple Inc. ("Apple"). Developer, not Apple, is solely responsible for the App and its content and for providing any maintenance and support services for the App; Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. For legal inquiries, contact: legal@ridepack.app.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; or (c) claims arising under consumer protection or similar legislation.

Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

2. License Grant

Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, in accordance with the App Store Terms of Service and this Agreement.

You represent and warrant that: (a) you are at least 13 years old (or the minimum age of digital consent in your jurisdiction, such as 16 in parts of the European Union) and are capable of forming a binding contract; (b) you are not located in, under the control of, or a national or resident of any country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (c) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the App.

3. Pricing

  • The App is free to download. Participating in rides — including group voice — requires an active subscription (Individual or Family) covering each rider.

4. Subscriptions

  • Subscriptions are offered through Apple's in-app purchase system and are subject to Apple's subscription terms.
  • Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription at any time through your Apple ID account settings.
  • No refunds are provided for partial subscription periods, except as required by applicable law or Apple's policies.
  • Individual subscriptions are per-rider: each rider's access to rides is gated on that rider's own subscription. Individual subscriptions are not shared between riders.
  • Family subscriptions support Apple Family Sharing: one Family subscription grants access to each member of the purchaser's Apple Family Sharing group (up to 6 people), subject to Apple's Family Sharing terms. Access for family members ends when the subscription lapses or sharing is revoked.
  • Developer reserves the right to change subscription pricing, billing intervals, and the features included in or excluded from a subscription at any time. Price changes take effect at the start of your next billing period. Where Apple requires your affirmative consent to a price increase, your subscription will not renew at the increased price unless you agree through Apple's prompt; otherwise, continued use of subscription features after a price change takes effect constitutes acceptance of the new price.

5. Acceptable Use

The App provides real-time voice communication between riders. You agree that you will not use the App to:

  • Harass, threaten, intimidate, or abuse other users
  • Transmit unlawful, offensive, defamatory, or obscene content
  • Impersonate another person or misrepresent your identity
  • Interfere with or disrupt the App's infrastructure or other users' ability to use the App
  • Use automated tools to generate voice transmissions or simulate rider presence
  • Violate any applicable local, state, national, or international law or regulation

Developer has zero tolerance for objectionable content or abusive behavior. If another rider engages in harassing, threatening, abusive, or otherwise objectionable conduct, you can leave the ride at any time and report the conduct to support@ridepack.app or legal@ridepack.app. Developer reviews reports of objectionable content and abusive users and takes appropriate action — which may include warning, suspending, or permanently banning the offending user — within a reasonable time. Developer reserves the right to suspend or terminate access for any user found to be in violation of these terms.

6. Voice & Audio Data

The App transmits voice audio in real time to other members of your active ride group. By using the App you acknowledge and consent to the following:

  • Transmission — your microphone transmits continuously to your group for the duration of a ride. You can tap Mute at any time to stop transmitting; no audio is sent while muted. Voice audio is routed through LiveKit infrastructure for real-time delivery and is not stored by Developer after transmission.
  • Group visibility — other members of your ride group will hear your voice transmissions in real time. Do not transmit anything you would not want your group to hear.
  • No monitoring — Developer does not monitor, record, or review voice content transmitted through the App.
  • Third-party infrastructure — LiveKit processes audio in transit. Their privacy policy applies to that processing.

7. Location Data

The App requests access to your device's location to enable proximity-based ride discovery and group coordination:

  • Your approximate location is used to surface nearby rides and broadcast your group's general position to other riders.
  • Precise coordinates are not stored after your ride ends. Location is processed in real time during a ride and discarded when the ride ends.
  • Location data is not sold to or shared with third parties for advertising or marketing purposes.

8. Restrictions

You agree that you will not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Modify, adapt, translate, or create derivative works based on the App
  • Sublicense, sell, resell, transfer, or otherwise exploit the App for commercial purposes
  • Remove, alter, or obscure any proprietary notices or labels
  • Use the App as a safety or emergency communication device — RidePack is not a substitute for emergency services

9. Intellectual Property

The App, including its design, code, audio assets, trademarks, and all related intellectual property, is owned by Developer and protected by applicable intellectual property laws. This Agreement does not grant you any ownership rights in the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Important: RidePack is not a safety device. Do not rely on the App for navigation, emergency communication, or any situation requiring guaranteed connectivity. Always ride safely and in accordance with local traffic laws.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in this Agreement excludes or limits Developer's liability for death or personal injury caused by Developer's negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Because some jurisdictions do not allow the exclusion or limitation of certain warranties or of liability for certain damages, some of the above exclusions and limitations may not apply to you.

12. Termination

This Agreement is effective until terminated. Developer may terminate this Agreement at any time if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices. Sections 9, 10, 11, and 14 survive termination.

13. Changes to This Agreement

Developer may update this Agreement, modify or remove App features, and change pricing at any time without prior notice, except where notice is required by applicable law or Apple's policies. Continued use of the App after changes are posted constitutes acceptance of the revised terms. Material changes affecting subscription pricing or the removal of features previously included with a paid subscription will be communicated to affected users before taking effect.

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to conflict of law principles. Any disputes arising under this Agreement shall be resolved in the courts of the State of Idaho. If you are a consumer, nothing in this section deprives you of the protection afforded by the mandatory consumer-protection laws of your country or state of residence, or of any right you may have to bring proceedings in your local courts where such rights cannot lawfully be waived.

15. Entire Agreement

This Agreement constitutes the entire agreement between you and Developer with respect to the App and supersedes all prior or contemporaneous understandings, written or oral. If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.
